The Government recently introduced an omnibus bill that will enable the Minister responsible for the RTA to ‘switch on’ restrictions on terminating tenancies in response to a COVID-19 public health order that generally restricts people from moving house.

As part of the Parliamentary process, the COVID-19 Response (Management Measures) Legislation Bill was referred to the Finance and Expenditure Committee, who have published their report and recommend several changes to tenancy terminations (Schedule 5) of the Bill taking into account issues raised by submitters.

Te Tūāpapa Kura Kāinga – Ministry of Housing and Urban Development in partnership with the Ministry of Business Innovation and Employment has supported the development of this legislation.

If passed into law, the aim of the new legislation is to provide much needed certainty and clarity for landlords and tenants. It’s also about being more prepared and avoiding the confusion seen in the rental sector with previous lockdowns.
